The City of Cudahy makes no claims, promises or guarantees about the accuracy, completeness, or adequacy of the contents of http://www.cityofcudahy.com/ (the "City Website") and expressly disclaims liability for errors and omissions in the contents of the City Website. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the contents of the City Website or its hyperlinks to other Internet resources. Neither the City of Cudahy nor any of its employees, or third party content providers, warrant that the City Website will be uninterrupted or error free; nor does the City, its employees or third part content providers, make any warranty as to the results that are obtained from the use of the City Website, or as to the reliability or content of any information, service, or merchandise provided through the City Website. Reference in the City Website to any specific commercial products, processes, or services, or the use of any trade, firm or corporation name, is for the information and convenience of the public, and does not constitute endorsement, recommendation, or favoring by the City of Cudahy.
Furthermore, the City of Cudahy, its employees, and third party content providers are not liable for defamatory, offensive or illegal conduct of other users or third-parties and the risk of injury from the foregoing conduct rests entirely with you. In no event will the City of Cudahy, its employees or third party content providers, or any person or entity involved in creating or producing the City Website, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use the City Website.
You expressly agree that use of the City Website is at your sole risk. You agree to defend, indemnify and hold harmless the City of Cudahy, its employees and third party providers, from and against all claims and expenses, including attorney’s fees, arising out of the use of the City Website by you or your account.
Types of Information We Collect: The information we gather is either information (for example, your name and address) that you voluntarily supply when you register or initiate transactions, or information gathered on usage patterns and preferences as visitors navigate the website, use our services such as e-mail, or read our e-mail newsletters.
Browser Level Information and IP Addresses: Our web server automatically collects limited information about your computer configuration when you visit our website, including the type of browser you use, the operating system you are running, the resolution of your computer monitor, the website that referred you, and your IP address. Your IP address is a number that is used by computers connected to the Internet to identify your computer so that data such as the web pages you want to view can be transmitted to you. We use IP address information for systems administration and troubleshooting purposes.
Other Disclosures: We may occasionally release information about our visitors when the release is appropriate to comply with the law, to protect the rights, property or safety of visitors to our sites, the public, our customers, or our government and its employees, agents, partners, and affiliates. The City of Cudahy does not disclose, sell, or transfer any information collected to third party companies.
Please keep in mind that our communities are public spaces, so don’t post anything that you don’t want the public to see. Credit card numbers, product keys, and other confidential information, including anything covered under a non-disclosure agreement (NDA), should not be posted to any blogs, discussions, or other public areas.
If a user chooses to provide the City with personal identifying information, such as sending an email to a City employee or by filling out and submitting an online application/submission form (that may require submission of personal identifying information) located on the City ’s website, the City may use that information to respond to the user’s message, to assist in obtaining information the user may have requested, or use the information in the manner contemplated by the online submission form. As further stated below, an online application/submission form containing personal identifying information will not be disclosed except as permitted by law.
In order to provide electronic commerce capabilities, the name, address and payment information (if applicable) that the user might provide when using this website may be collected, processed and disclosed to complete an online transaction and for record-keeping for such activities as billing, permits, licenses and other business-related purposes.
By using email addresses provided at registration or otherwise, users are giving the City permission to periodically send out email newsletters and promotional email to our users about website updates, and product and service information offered by the City. Users may indicate that they do not wish to receive email information from the City. Upon request, the City will remove users, and their information, from the City database or permit them to elect not to receive any further email newsletters or contact.
Notwithstanding the above provisions of this section, information submitted to the City’s website may be subject to disclosure to another party pursuant to various provisions of California law, including, but not limited to, the California Civil Discovery Act of 1986 and the California Public Records Act (Government Code Section 6250 et seq.). The City only shares such information with another government agency if the user’s inquiry relates to that agency, to protect the interests of others, to protect and defend the rights or property of the City or as otherwise provided by law. Credit card information will not be disclosed.
Unless a particular web page on the City’s website indicates that encryption technology is being used, the user should not assume that information uploaded through that web page to the City’s server will be treated as confidential. If a user submits information to the City’s server through a web page containing visible indicators of active encryption technology, the City will take reasonable precautions to safeguard the confidentiality of such information, but shall nevertheless not be held liable for any injury caused by the disclosure of that information, whether caused by security breach, accident, inadvertence, or any other act resulting in disclosure. The City limits access to your personal information to only those employees who need it to perform the service requested.
Non City Websites
Non-city websites may be linked through the City’s website. Many non-city sites may or may not be subject to the Public Records Act and may or may not be subject to other sections of California Code or federal law. Visitors to such sites are advised to check the privacy statements of such sites and to be cautious about providing personally identifiable information without a clear understanding of how the information will be used.
